CIV.R. 56(C): In a negligence action brought by homeowners against an engineering firm arising from a landslide, the trial court erred in granting summary judgment to the engineering firm on the basis of the economic-loss rule, because the homeowners alleged damage to tangible property, and not purely economic loss, including damage to the foundation of their home, landscaping, the utilities lines, trees, the retaining wall, the pool, and the land.
