COURT OF APPEALS
THIRTEENTH DISTRICT OF TEXAS
CORPUS CHRISTI – EDINBURG
CN HOLDING, LLC AND
INTERESTED PARTIES CLAIMING
AN INTEREST THROUGH CN
HOLDING, LLC, Appellants,
v.
YESENIA LYNETT CANTU AND
RICARDO CANTU, Appellees.
ON APPEAL FROM THE 139TH DISTRICT COURT
OF HIDALGO COUNTY, TEXAS
MEMORANDUM OPINION
Before Justices Silva, Peña, and West
Memorandum Opinion by Justice West
The trial court entered a temporary injunction order (TI) that does not set a trial
date. On appeal, appellants assert the TI is void. We agree.
Rule 683 provides that a TI “shall include” a trial setting. TEX. R. CIV. P. 683. When
a TI lacks a trial setting, appellate courts must declare void and dissolve the TI and
remand the case to the trial court for further proceedings. Qwest Comm. Corp. v. AT&T
Corp., 24 S.W.3d 334, 337–38 (Tex. 2000); Conway v. Shelby, 432 S.W.3d 377, 380–81
(Tex. App.—Texarkana 2014, no pet.).
Accordingly, without reaching the merits, we declare void and dissolve the TI and
remand this case to the trial court for further proceedings. All pending motions are denied.
