ON APPEAL FROM THE 430TH DISTRICT COURT OF HIDALGO COUNTY, TEXAS CONCURRING MEMORANDUM OPINION Before Justices Peña, West, and Fonseca Concurring Memorandum Opinion by Justice West I disagree with the Majority’s analysis but concur in the result because the incident report states the collision occurred at 7:48 p.m., and the call log and testimony from Officer Villarreal provide he was removed from the call at 7:47 p.m. Taking this evidence as true and indulging all inferences in favor of Cazares, she has presented evidence that Officer Villarreal was removed from the call at the time of the collision.
