IN RE OSCAR REYES LUNA, JR., RELATOR
ORIGINAL PROCEEDING
October 20, 2026
MEMORANDUM OPINION
Before PARKER, C.J., and YARBROUGH and PRATT, JJ.
Relator, Oscar Reyes Luna, Jr., a Texas inmate proceeding pro se, filed a “Motion
for an Order Compelling District Clerk to Provide Missing Portions of Findings of Facts
and Conclusions of Law,” requesting that this Court compel Potter County District Clerk
Stephanie Menke to provide copies of certain documents purportedly filed in his two
criminal cases.1 We construe the document as a petition for writ of mandamus seeking
relief in two criminal causes and dismiss it for want of jurisdiction.
1 See Luna v. State, Nos. 07-23-00139-CR, 07-23-00140-CR, 2024 Tex. App. LEXIS, at *6 (Tex.
App.—Amarillo June 3, 2024, pet. ref’d) (mem. op., not designated for publication) (affirming Luna’s
convictions).
We have authority to issue writs of mandamus against a judge of a district or county
court in our appeals district and all writs necessary to enforce our jurisdiction. See TEX.
GOV’T CODE § 22.221(a), (b). Luna does not request mandamus relief against a district
or county judge and has not demonstrated how issuance of the requested writ against the
Potter County District Clerk is necessary to enforce our jurisdiction. Consequently, we
are without authority to issue said writ. See In re Dunn, No. 07-25-00105-CV, 2025 Tex.
App. LEXIS 2494, at *2 (Tex. App.—Amarillo Apr. 10, 2025, no pet.) (mem. op.) (holding
that appellate court lacked jurisdiction to issue mandamus against district clerk’s office).
Accordingly, these original proceedings are dismissed for want of jurisdiction.
