IN RE TOMMIE J. DENSON, RELATOR
ORIGINAL PROCEEDING
September 30, 2026
MEMORANDUM OPINION
Before PARKER, C.J.. and DOSS and PRATT, JJ.
Relator, Tommie J. Denson, a Texas inmate proceeding pro se, filed a petition for
writ of mandamus seeking to compel the Potter County District Clerk, Stephanie Menke,
to file certain documents in his post-conviction criminal case. We dismiss this original
proceeding for want of jurisdiction.
We have authority to issue writs of mandamus against a judge of a district or county
court in our appeals district and all writs necessary to enforce our jurisdiction. See TEX.
GOV’T CODE § 22.221(a), (b). Denson does not request mandamus relief against a district
or county judge and has not demonstrated how issuance of the requested writ against the
Potter County District Clerk is necessary to enforce our jurisdiction. Consequently, we
are without authority to issue said writ. See In re Dunn, No. 07-25-00105-CV, 2025 Tex.
App. LEXIS 2494, at *2 (Tex. App.—Amarillo Apr. 10, 2025, no pet.) (mem. op.) (holding
that appellate court lacked jurisdiction to issue mandamus against district clerk’s office).
Accordingly, Denson’s petition for writ of mandamus is dismissed for want of
jurisdiction.
