MEMORANDUM OPINION
No. 04-26-00137-CV
Amy Lynn RODRIGUEZ,
Appellant
v.
Jesus RODRIGUEZ, Jr,
Appellee
From the 166th Judicial District Court, Bexar County, Texas
Trial Court No. 2022-CI-00369
Honorable Laura Salinas, Judge Presiding
PER CURIAM
Sitting: Rebeca C. Martinez, Chief Justice
Irene Rios, Justice
Velia J. Meza, Justice
Delivered and Filed: September 2, 2026
DISMISSED FOR WANT OF PROSECUTION
Appellant’s brief was originally due June 1, 2026. On May 28, 2026, appellant filed a
motion for extension of time to file her brief which was granted and extended her brief deadline to
July 1, 2026. However, on July 1, 2026, no brief was filed. On July 29, 2026, we ordered appellant
to file her brief in this court no later than August 17, 2026, along with a written response reasonably
explaining: (1) her failure to timely file the brief and/or a motion for extension; and (2) why
appellee is not significantly injured by appellant’s failure to timely file a brief. We warned that if
04-26-00137-CV
she failed to file a brief and written response by the date ordered, this appeal would be dismissed
for want of prosecution. See TEX. R. APP. P. 38.8(a)(1), 42.3(c).
To date, appellant has not filed a brief nor responded to our order. Accordingly, we dismiss
this appeal for want of prosecution.
