MEMORANDUM OPINION
Nos. 04-25-00744-CV and 04-26-00232-CV
IN THE ESTATE OF Olga TAMEZ DE SUDAY
From the Probate Court No. 1, Bexar County, Texas
Trial Court No. 2019-PC-3811
Honorable Oscar J. Kazen, Judge Presiding
PER CURIAM
Sitting: Adrian A. Spears II, Justice
H. Todd McCray, Justice
Velia J. Meza, Justice
Delivered and Filed: September 23, 2026
DISMISSED
On April 14, 2026, we consolidated Appeal Nos. 04-25-00744-CV and 04-26-00232-CV
for purposes of briefing and argument, and stated that this court would dispose of the appeals with
the same judgment, opinion, and mandate. On August 25, 2026, Appellant Maryvel Suday, as
Independent Executrix of the Estate of Olga Tamez de Suday, Deceased, filed an unopposed
motion to dismiss these appeals pursuant to Texas Rule of Appellate Procedure 42.1(a).
Appellant’s motion to dismiss contains a certificate of service to appellee, who has not opposed
the motion. We grant the motion to dismiss and dismiss the appeal. See TEX. R. APP. P. 42.1(a)(1)
(“In accordance with a motion of appellant, the court may dismiss the appeal or affirm the appealed
judgment or order unless such disposition would prevent a party from seeking relief to which it
04-25-00744-CV & 04-26-00232-CV
would otherwise be entitled.”). Costs of appeal are taxed against appellant. See id. 42.1(d) (“Absent
agreement of the parties, the court will tax costs against the appellant.”).
