Tenth Appellate District of Texas
10-26-00364-CR
Ex parte Viki Steve Parker
On appeal from the
19th District Court of McLennan County, Texas
Judge Thomas C. West, presiding
Trial Court Cause No. 2024-1406-C1
CHIEF JUSTICE JOHNSON delivered the opinion of the Court.
MEMORANDUM OPINION
Appellant, Viki Steve Parker, filed a pro se appeal from the denial of a
writ of habeas corpus related to the amount of pre-trial bail. Since the appeal
was filed, Appellant pled guilty to a lesser-included offense and waived his
right to appeal. We dismiss this appeal because it has now become moot.
A case that is moot is normally not justiciable. See Pharris v. State, 165
S.W.3d 681, 687-88 (Tex. Crim. App. 2005); see also Ex parte Mozon, No. 10-
21-00315-CR, 2022 WL 118317, 2022 Tex. App. LEXIS 212 (Tex. App.โWaco
Jan. 12, 2022, no pet.) (mem. op., not designated for publication). โThe
longstanding rule in Texas regarding habeas corpus is that where the premise
of a habeas corpus application is destroyed by subsequent developments, the
legal issues raised thereunder are moot.โ See Mozon, 2022 Westlaw 118317
(citing Ex parte Guerrero, 99 S.W.3d 852, 853 (Tex. App.โHouston [14th Dist.]
2003, no pet.) (per curiam).
Accordingly, because Parker is no longer subject to pre-trial bail because
he pled guilty and has been sentenced accordingly, we dismiss this appeal.
