NUMBER 13-26-00627-CV COURT OF APPEALS THIRTEENTH DISTRICT OF TEXAS CORPUS CHRISTI – EDINBURG COUNTY OF HIDALGO, TEXAS, Appellant, v. BERNARDO BELTRAN-ROSAS, Appellee. ON APPEAL FROM THE 389TH DISTRICT COURT OF HIDALGO COUNTY, TEXAS MEMORANDUM OPINION Before Chief Justice Tijerina and Justices Cron and Fonseca Memorandum Opinion by Justice Cron This cause is before the Court on its own motion. On September 4, 2026, appellant filed a notice of appeal attempting to appeal an “order denying defendant’s motion for reconsideration of denial of plea to the jurisdiction” signed by the trial court on August 17, 2026. On September 10, 2026, the Clerk of the Court notified appellant that it appears the order it is attempting to appeal is unappealable. Appellant was further notified that if the defect was not cured within ten days, the appeal would be dismissed. See TEX. R. APP. P. 42.3. To date, appellant has failed to respond to the notice and has otherwise not cured the defect. We are of the opinion that the order appellant is attempting to appeal is unappealable, appellant has failed to cure the defect, and the Court does not have jurisdiction over the appeal. Accordingly, the appeal is dismissed for want of jurisdiction. See id. R. 42.3(a). JENNY CRON Justice Delivered and filed on the 15th day of October, 2026. 2
