Tenth Appellate District of Texas

Dalton Joe James,
Appellant
v.
Jana Yoder,
Appellee
On appeal from the
74th District Court of McLennan County, Texas
Judge Peter Rusek, presiding
Trial Court Cause No. 2026-696-3
JUSTICE HARRIS delivered the opinion of the Court.
MEMORANDUM OPINION
Dalton Joe James appeals from an order that granted a motion for
summary judgment as to one of multiple defendants in a workers’
compensation proceeding. By letter from the Clerk of this Court dated August
3, 2026, Appellant was informed that the appeal was subject to dismissal for
want of jurisdiction because the order does not appear to be a final, appealable
judgment but was interlocutory. Appellant was directed to file a response with
the Court showing grounds for continuing the appeal on or before August 13,
2026. Appellant was warned that the failure to respond to the Clerk’s letter
would be an independent basis upon which the appeal could be dismissed
without further notice.
Appellant has not responded to the Clerk’s letter. Accordingly, this
appeal is dismissed for want of jurisdiction, want of prosecution, and the
failure to follow a directive from the Clerk of this Court. See Tex. R. App. P.
