Appellees
On appeal from the
13th District Court of Navarro County, Texas
Judge James E. Lagomarsino, presiding
Trial Court Cause No. D23-31773-CV
JUSTICE SMITH delivered the opinion of the Court.
MEMORANDUM OPINION
Appellants appealed from an order granting a petition for declaratory
judgment. On September 8, 2026, Appellants submitted a document entitled
“Appellants’ Notice of Non-Suit of Appeal” asking, in essence, that the appeal
be dismissed. We will construe the document as a motion to dismiss the appeal.
See TEX. R. APP. P. 42.1(a)(1).
The Appellants’ motion is granted. Accordingly, this appeal is dismissed.
