ABRAHAM, WATKINS, NICHOLS, AGOSTO, AZIZ & STOGNER, Appellee On Appeal from the 11th District Court Harris County, Texas Trial Court Case No. 2022-76196 MEMORANDUM OPINION Appellant Edward Festeryga filed a notice of appeal from the trial court’s October 25, 2023 Order Denying [Appellant’s] TCPA Motion. On October 15, 2024, this Court abated the appeal while a related case was pending in the Fifth Circuit. On December 30, 2025, the parties filed a Joint Notice of Settlement and Request for Dismissal of Appeal stating that the federal case concluded, and that “on December 29, 2025, the [parties] mediated and settled all claims pending between them” and requesting that we “dismiss this appeal.” We construe the parties’ notice as a motion. We reinstate the appeal on the Court’s active docket, grant the parties’ joint motion, and dismiss the appeal. Any pending motions are dismissed as moot.
