In the Court of Appeals Second Appellate District of Texas at Fort Worth ___________________________ No. 02-25-00649-CV ___________________________ RAHUL PATEL D/B/A TRANSCONTINENTAL ENERGY SERVICES, Appellant V. HOWARD SUPPLY COMPANY, LLC, Appellee On Appeal from the 67th District Court Tarrant County, Texas Trial Court No. 067-362092-25 Before Sudderth, C.J.; Kerr and Birdwell, JJ. Per Curiam Memorandum Opinion MEMORANDUM OPINION AND JUDGMENT Appellant’s brief was due several months ago—in April 2026—but we granted his request to abate the appeal for settlement discussions until August 10, 2026. The parties did not report a successful settlement by that date, so the case was automatically reinstated on August 11, 2026. Yet, Appellant still failed to file a brief. See Tex. R. App. P. 38.1, 38.8(a). We reminded Appellant that his brief was due and warned him that we could dismiss his appeal for want of prosecution unless, within ten days, he filed a brief and an accompanying motion reasonably explaining the brief’s untimeliness. See Tex. R. App. P. 10.5(b), 38.8(a)(1), 42.3(b). More than twenty days have passed since we issued that warning, and we have not received a response. Because Appellant has failed to file a brief, we dismiss his appeal for want of prosecution. See Tex. R. App. P. 38.8(a)(1), 42.3(b), 43.2(f). Appellant must pay all costs of this appeal.
