ON APPEAL FROM THE COUNTY COURT AT LAW NO. 4 OF HIDALGO COUNTY, TEXAS MEMORANDUM OPINION Before Justices Peña, West, and Fonseca Memorandum Opinion by Chief Justice Fonseca This matter is before the court on appellant’s failure to file a brief. On May 5, 2026, the Clerk’s record was received in this case. On June 23, 2026, the Clerk of the Court notified appellant that no reporter’s record had been received and that unless the defect was cured, the Court will consider and decide those issues or points that do not require a reporter’s record. Appellant did not respond to the notice; therefore, it is our opinion that the briefing timeline began the date the appellate record was complete, in this case on the date the clerk’s notice was received. See TEX. R. APP. P. 38.6(a). On July 27, 2026, the Clerk of the Court notified appellant that appellant’s brief was past due. Appellant was further notified that if appellant fails to reasonably explain the failure to file a brief within ten days from the date of the notice, the appeal shall be dismissed for want of prosecution. See id. R. 38.8(a)(1), 42.3(b), (c). To date, appellant has failed to file a brief and has not otherwise responded to the clerk’s notices; accordingly, the appeal is dismissed for want of prosecution. See id. YSMAEL D.
