In The Court of Appeals Ninth District of Texas at Beaumont __________________ NO. 09-26-00400-CV __________________ IN RE HARIS ABDULLAH __________________________________________________________________ Original Proceeding County Court at Law No. 3 of Montgomery County, Texas Trial Cause No. 23-09-13758 __________________________________________________________________ MEMORANDUM OPINION Relator Haris Abdullah filed a petition for a writ of mandamus. Relator contends the final order signed on November 20, 2024, in Trial Cause Number 23- 09-13758, is void because the trial court deprived Relator of due process under the Fourteenth Amendment by failing to follow correctly the procedure for determining the enforceability of an arbitration award based on what he describes as โ€œforeign law.โ€ See generally Tex. R. Civ. P. 308b. Relator contends his challenge to the arbitration award based on Rule 308b was before the trial court before rendition of judgment in Trial Cause Number 23-09-13758. Relator also contends he is entitled 1 to mandamus relief notwithstanding the pending appeal from the denial of his bill of review. 1 We may issue a writ of mandamus to remedy a clear abuse of discretion by the trial court when the relator lacks an adequate remedy by appeal. See In re Prudential Ins. Co. of Am., 148 S.W.3d 124, 135-36 (Tex. 2004) (orig. proceeding); Walker v. Packer, 827 S.W.2d 833, 839-40 (Tex. 1992) (orig. proceeding). After reviewing the mandamus petition and record, we conclude that Relator has failed to establish that he lacks an adequate remedy by appeal. Accordingly, we deny the petition for a writ of mandamus. See Tex. R. App. P. 52.8(a). PETITION DENIED. PER CURIAM Submitted on October 7, 2026 Opinion Delivered October 8, 2026 Before Golemon, C.J., Johnson and Chambers, JJ. 1 The Clerk of the Court docketed the appeal from the bill of review case, Trial Cause Number 26-04-06077, as Appeal Number 09-26-00376-CV, Haris Abdullah v. Shamaila Haris. We express no opinion regarding any issues that may be presented in that appeal. 2
