Fifth Circuit Court of Appeal State of Louisiana No. 26-KH-499 GEORGE OUBRE versus 23RD JUDICIAL DISTRICT COURT IN RE GEORGE OUBRE APPLYING FOR SUPERVISORY WRIT FROM THE TWENTY-THIRD JUDICIAL DISTRICT COURT, PARISH OF ST JAMES, STATE OF LOUISIANA, DIRECTED TO THE HONORABLE JASON VERDIGETS, DIVISION "A", No. 8795 November 04, 2026 Panel composed of Judges Susan M. Chehardy, Stephen J. Windhorst, and Scott U. Schlegel WRIT GRANTED Relator seeks a second writ of mandamus compelling the trial judge to comply with this Court’s earlier order regarding relator’s prior writ of mandamus. The 23rd Judicial District Court has still not ruled on the merits of relator’s Petition to Amend Application for Post-Conviction Relief (APCR) filed on January 9, 2026 in case number 8795, despite a prior order from this Court to do so. See Oubre v. 23rd Jud. Dist. Ct., No. 26-KH-390, 2026 WL 2547337 (La. App. 5 Cir. Aug. 28, 2026). We hereby grant relator’s writ and instruct the trial court, if it has not already complied, to rule upon relator’s Petition to Amend Application for Post-Conviction Relief filed on or about January 9, 2026. The district court is instructed to decide said motion within 30 days of this decree. The Clerk of Court for the 23rd Judicial District Court is ordered to furnish a copy of the district court’s merits ruling on relator’s Petition to Amend Application and for Post-Conviction Relief as soon practicable, to both relator and this court.
