STATE OF LOUISIANA COURT OF APPEAL, FIRST CIRCUIT NICOLE JACKSON NO. 2026 CW 1398 VERSUS THE ESTATE OF DAVID NEWMAN, JR. AND EDNA NEWMAN-BLUNT, INDIVIDUALLY AND IN HER CAPACITY AS INDEPENDENT EXECUTRIX OF THE SUCCESSTON OF DAVID NEWMAN, JR. NOVEMBER 5, 2026 In Re: Nicole Jackson, applying for supervisory writs, 19th Judicial District Court, Parish of Bast Baton Rouge, No. 782310. BEFORE: PENZATO, LANIER, AND FIELDS, Jd. STAY DENIED; WRIT GRANTED WITH ORDER. The portion of the district court’s October 12, 2026 judgment which denied relator’s request for preliminary injunction is an appealable judgment. See La. Code Civ. P. art. 3612. While the grant of the exception of res judicata may be appealable, the judgment lacks the proper decretal language to make such a determination. Thus, the writ application is granted for the limited purpose of remanding this matter to the district court with instructions to grant an appeal to relator pursuant to her notice of intent to seek supervisory writs. See In Re Howard, 541 So.2d 195 (La. 1989) (per curiam). Additionally, a copy of this court’s order is to be included in the appellate record.
