Electronically Filed Supreme Court SCPW-XX-XXXXXXX 23-OCT-2026 09:43 AM Dkt. 9 ODDP SCPW-XX-XXXXXXX IN THE SUPREME COURT OF THE STATE OF HAWAIʻI ________________________________________________________________ IN RE SAMSON KUMUHONE ________________________________________________________________ ORIGINAL PROCEEDING (CASE NO. 1CPC-XX-XXXXXXX) ORDER DENYING PETITIONS WITHOUT PREJUDICE (By: Devens, C.J., McKenna, Eddins, and Ginoza, JJ., and Circuit Judge Medeiros, assigned by reason of vacancy) Letters from Petitioner were filed in this court on July 6 and August 5, 2026. We construe these letters as petitions for extraordinary writ. Upon consideration of these petitions and the record, Petitioner has not demonstrated a clear and indisputable right to relief nor a lack of alternatives to obtain the relief sought. See Womble Bond Dickinson (US) LLP v. Kim (Womble), 153 Hawaiʻi 307, 319, 537 P.3d 1154, 1166 (2023). Post-conviction relief should instead be first pursued by filing a petition in the circuit court pursuant to Rule 40 of the Hawaiʻi Rules of Penal Procedure (HRPP). It is ordered that the petitions are denied without prejudice to filing a HRPP Rule 40 petition in the circuit court. DATED: Honolulu, Hawaii, October 23, 2026. /s/ Vladimir P. Devens /s/ Sabrina S.
