OF THE STATE OF HAWAIʻI
CYNTHIA MURPHY, Petitioner-Appellee,
v.

APPEAL FROM THE DISTRICT COURT OF THE FIRST CIRCUIT
HONOLULU DIVISION
(CASE NO. 1DSS-XX-XXXXXXX)
ORDER DISMISSING APPEAL
(By: Hiraoka, Presiding Judge, Wadsworth and Gluck, JJ.)
Upon review of the record, it appears that:
(1) The statement of jurisdiction and opening brief
were due on or before May 25, 2026, and June 24, 2026,
respectively;
(2) Self-represented Respondent-Appellant William T.
Widawsky (Widawsky) failed to file either document or request an
extension of time;
(3) On July 22, 2026, the appellate clerk entered a
default notice informing Widawsky that the time for filing the
statement of jurisdiction and opening brief had expired, the
NOT FOR PUBLICATION IN WEST'S HAWAIʻI REPORTS AND PACIFIC REPORTER
matter would be called to the court's attention on August 3,
2026, for appropriate action, which could include dismissal of
the appeal, under Hawaiʻi Rules of Appellate Procedure
Rules 12.1(e) and 30, and Widawsky could request relief from
default by motion; and
(4) Widawsky has not taken any further action in this
appeal.
Therefore, IT IS HEREBY ORDERED that the appeal is
dismissed.
DATED: Honolulu, Hawaiʻi, October 1, 2026.
