NOT FOR PUBLICATION IN WEST'S HAWAI#I REPORTS AND PACIFIC REPORTER Electronically Filed Intermediate Court of Appeals CAAP-XX-XXXXXXX 23-SEP-2026 08:53 AM Dkt. 266 ODSLJ NO. CAAP-XX-XXXXXXX IN THE INTERMEDIATE COURT OF APPEALS OF THE STATE OF HAWAI#I IN THE MATTER OF THE LIVING ESTATE OF JAMIE JEFFREY HABIG, SETTLOR AND TRUSTEE, Petitioner-Appellant APPEAL FROM THE CIRCUIT COURT OF THE FIFTH CIRCUIT (CASE NO. 5CLP-XX-XXXXXXX) ORDER DISMISSING APPEAL FOR LACK OF JURISDICTION (By: Nakasone, Chief Judge, Hiraoka and Gluck, JJ.) Upon review of the record, it appears that on November 15, 2025, self-represented Petitioner-Appellant Jamie Jeffrey Habig filed a notice of appeal seeking to appeal from "[a]ll prior denials of motions, petitions, and requests," and "[a]ny and all orders, rulings, or inactions of the Court that affect the rights, authority, or standing of the Temporary Trustee in administering the Estate" by the Circuit Court of the Fifth Circuit in 5CLP-XX-XXXXXXX. On September 16, 2026, Habig filed in the appeal a second notice of appeal, purporting to appeal from the "deemed denial" of his June 17, 2026 Petition for Termination of Guardianship and Petition for Production of Records, which the court construes as an amended notice of appeal. The Circuit Court has not entered a judgment in the underlying case under Hawai#i Probate Rules Rule 34(a) or (c), none of the orders or decisions from which Habig appeals are NOT FOR PUBLICATION IN WEST'S HAWAI#I REPORTS AND PACIFIC REPORTER independently appealable under the collateral order or Forgay1 doctrines, and the Circuit Court has not granted leave for interlocutory appeal under Hawaii Revised Statutes ยง 641-1(b) (2016). See Greer v. Baker, 137 Hawai#i 249, 253, 369 P.3d 832, 836 (2016) (setting forth the requirements for appealability under the collateral order and Forgay doctrines)). Therefore, IT IS HEREBY ORDERED that the appeal is dismissed for lack of jurisdiction. IT IS FURTHER ORDERED that all pending motions are dismissed.
