NO. CAAP-XX-XXXXXXX
IN THE INTERMEDIATE COURT OF APPEALS
OF THE STATE OF HAWAIʻI
BRANDY K.L.L. LECKER-TOLENTINO on behalf of W.F.,
Petitioner-Appellant,
v.
SHANNON W. MOLLENA, Respondent-Appellee.
APPEAL FROM THE DISTRICT COURT OF THE SECOND CIRCUIT
WAILUKU DIVISION
(CASE NO. 2DSS-XX-XXXXXXX)
ORDER APPROVING STIPULATION TO DISMISS APPEAL
(By: Nakasone, Chief Judge, Wadsworth and McCullen, JJ.)
Upon consideration of the Stipulation to Dismiss
Appeals (Stipulation), filed August 17, 2026, by Petitioner-
Appellant Brandy Lecker-Tolentino, the papers in support, and
the record, it appears that (1) the appeal has been docketed;
(2) filing fees have been paid; (3) under Hawaiʻi Rules of
Appellate Procedure (HRAP) Rule 42(a), the parties stipulate to
dismiss the appeal with prejudice and bear their own attorneys'
fees and costs incurred in this appeal; (4) the Stipulation is
signed by counsel for all appearing parties; (5) the Stipulation
does not meet the requirements for dismissal under HRAP
NOT FOR PUBLICATION IN WEST'S HAWAIʻI REPORTS AND PACIFIC REPORTER
Rule 42(a) because the appeal was docketed on September 23,
2026, after the Stipulation was filed; however, (6) the
Stipulation satisfies the requirements for dismissal under HRAP
Rule 42(b).
Therefore, IT IS HEREBY ORDERED that the Stipulation
is approved under HRAP Rule 42(b) and the appeal is dismissed
with prejudice. The parties shall bear their own attorneys'
fees and costs incurred in this appeal.
IT IS FURTHER ORDERED that all pending motions are
dismissed.
DATED: Honolulu, Hawaiʻi, September 25, 2026.
