ORDER DISMISSING APPEAL
(By: Nakasone, Chief Judge, Wadsworth and McCullen, JJ.)
Upon review of the record, it appears that:
(1) On February 5, 2026, self-represented Respondent-
Appellant J.H. filed the notice of appeal in this case;
(2) On February 18, 2026, the family court clerk
notified J.H. that J.H.'s request to proceed in forma pauperis
was denied and the filing fees needed to be paid, and cautioned
J.H. that failure to pay the fees may result in the appeal being
dismissed;
(3) The record on appeal was due on or before April 6,
2026, see Hawaiʻi Rules of Appellate Procedure (HRAP)
NOT FOR PUBLICATION IN WEST'S HAWAIʻI REPORTS AND PACIFIC REPORTER
Rule 11(b)(1), but was not filed because J.H. failed to pay the
filing fees or obtain a fee waiver;
(4) On May 14, 2026, the appellate clerk entered a
default of the record on appeal;
(5) On June 29, 2026, the court entered an order
granting a June 8, 2026 motion by J.H. seeking relief from
default of the record on appeal and additional time to pay the
filing fees for this appeal;
(6) The June 29, 2026 order extended the deadline for
J.H. to pay the filing fees in this appeal to July 29, 2026, and
cautioned that failure to comply with the order may result in
dismissal of this appeal; and
(7) J.H. has not taken any further action in this
appeal. An appeal may be dismissed where the record on appeal
has not been prepared because the appellant failed to pay the
required fees or obtain an order allowing the appellant to
proceed in forma pauperis. HRAP Rule 11(b)(2), (c)(2).
Therefore, IT IS HEREBY ORDERED that the appeal is
dismissed.
