ATLANTA,____________________

The Court of Appeals hereby passes the following order:
A27D0242. CHAD YOUNGBLOOD REPAIR LLC v. MILLARD WILKINSON.
Chad Youngblood Repair LLC filed a discretionary application from a trial
court order denying its motion for attorney fees pursuant to OCGA § 9-11-68 and
OCGA § 9-15-14. An appeal from a trial court order awarding or denying attorney fees
under OCGA § 9-15-14 must be initiated by filing an application for discretionary
appeal. OCGA § 5-6-35(a)(10), (b); Low v. Swift, 367 Ga. App. 874, 876 (889 SE2d
122) (2023). However, an order denying fees sought pursuant to OCGA § 9-11-68 is
subject to direct appeal. See Carr v. Yim, 369 Ga. App. 389 (893 SE2d 801) (2023).
Under OCGA § 5-6-35(j), this Court will grant a timely application for
discretionary review if the lower court’s order is subject to direct appeal. City of
Rincon v. Couch, 272 Ga. App. 411, 412 (612 SE2d 596) (2005). Accordingly, this
application is hereby GRANTED. Chad Youngblood Repair shall have ten days from
the date of this order to file a notice of appeal in the superior court. See OCGA §
5-6-35(g). If it already has filed a notice of appeal in the superior court, then it need
not file a second notice. The clerk of the superior court is DIRECTED to include a
copy of this order in the record transmitted to the Court of Appeals.
