Court of Appeals of the State of Georgia ATLANTA,____________________ October 30, 2026 The Court of Appeals hereby passes the following order: A27D0260. DONATTA WILDER v. 3620 PARKWAY LLC. The trial court granted 3620 Parkway LLC’s motion for summary judgment and awarded a judgment against defendant Donatta Wilder in the amount of $10,200.91, which included $9,933.41 in principal and $267.50 in costs. Wilder filed this timely application for discretionary appeal from the trial court’s order. Where the amount of the judgment in an action for damages is $10,000 or less, an application for discretionary appeal is required. Ca-Shar, Inc. v. McKesson Corp., 204 Ga. App. 865, 865 (420 SE2d 810) (1992). See OCGA § 5-6-35(a)(6), (b). However, judgments include not only the principal amount, but also interest, costs and fees. Castleberry’s Food Co. v. Smith, 205 Ga. App. 859, 861 (1) (424 SE2d 33) (1992). Under OCGA § 9-11-56(h), the grant of summary judgment is reviewable by direct appeal. City of Demorest v. Town of Mount Airy, 282 Ga. 653, 654, n. 1 (653 SE2d 43) (2007). Accordingly, an application for discretionary appeal was not required in this case. When a party files a timely application for discretionary appeal of a directly appealable order, we grant the application under OCGA § 5-6-35(j). Accordingly, this application is hereby GRANTED. Wilder shall have ten days from the date of this order to file a notice of appeal in the trial court. If she has already filed a notice of appeal in the trial court, she need not file a second notice. The clerk of the trial court is DIRECTED to include a copy of this order in the record transmitted to the Court of Appeals.
