Court of Appeals
of the State of Georgia
ATLANTA,____________________
October 22, 2026
The Court of Appeals hereby passes the following order:
A27A0595. KYLE RAMSEY v. THE SUPERIOR COURT OF HOUSTON
COUNTY.
On August 19, 2026, the trial court entered an order dismissing Kyle Ramsey’s
pro se petition for a writ of mandamus and denying his request to proceed in forma
paupers in the mandamus proceeding. Ramsey filed a pro se notice of appeal on
September 28, 2026.1 We lack jurisdiction.
A notice of appeal must be filed within 30 days of entry of the judgment or trial
court order sought to be appealed. OCGA § 5-6-38(a). The proper and timely filing
of a notice of appeal is an absolute requirement to confer appellate jurisdiction on this
Court. Perlman v. Perlman, 318 Ga. App. 731, 739(4) (734 SE2d 560) (2012). Ramsey’s
notice of appeal was filed 40 days after entry of the order he seeks to appeal.
1
Ramsey also sought to appeal the August 19 order by filing, in this Court, an
application for discretionary review, which we denied. Ramsey v. Super. Ct. of Houston
County, Case No. A27D0159 (Oct. 8, 2026).
Consequently — and pretermitting whether this untimely appeal suffers from
additional jurisdictional defects — it is hereby DISMISSED for lack of jurisdiction.
