The Court of Appeals hereby passes the following order:
A27D0095. ERIC LEE FINK v. THE STATE.
On July 23, 2026, the trial court revoked the balance of Eric Lee Fink’s
probation. On August 25, 2026, Fink filed an application for discretionary review in
this Court. We, however, lack jurisdiction.
To be timely, an application for discretionary appeal must be filed within 30
days of entry of the order sought to be appealed. OCGA § 5-6-35(d). The
requirements of OCGA § 5-6-35 are jurisdictional, and this Court cannot accept an
application for appeal not made in compliance with these requirements. Boyle v. State,
190 Ga. App. 734, 734 (380 SE2d 57) (1989). Because Fink filed this application on
August 25, 33 days after entry of the order revoking his probation, it is untimely.
Accordingly, we are without jurisdiction to consider this application and it is hereby
DISMISSED.
