ATLANTA,____________________
October 06, 2026
The Court of Appeals hereby passes the following order:
A27D0183. GUERDY CLAIMON v. KARLENE MONROE.
In this post-divorce proceeding, the trial court issued an order on April 9, 2026,
finding Guerdy Claimon in contempt for failure to comply with financial obligations
set forth in the final divorce decree. On September 24, 2026, Claimon filed the instant
application for discretionary review. We lack jurisdiction because the application is
untimely.
An application for discretionary review must be filed within 30 days of entry of
the order to be appealed. OCGA § 5-6-35(d). This statutory deadline is jurisdictional,
and we cannot accept an application for appeal not made in compliance with it. Boyle
v. State, 190 Ga. App. 734, 734 (380 SE2d 57) (1989). Claimon’s application is
untimely because he filed it more than 30 days after entry of the trial court’s order
finding him in contempt.1 Accordingly, the application is hereby DISMISSED.
1
Claimon’s apparent argument, that the application is timely because this Court
previously dismissed his direct appeal of the trial court’s order on the basis that a
discretionary application was required, lacks merit. See Case No. A27A0300 (Sept.
17, 2026). Under OCGA § 5-6-35(d), a party seeking to appeal an order subject to the
discretionary application procedure must file an application with the appellate court
within 30 days of entry of the order to be appealed.
In light of the dismissal of Claimon’s application, Claimon’s “Motion for
Contempt of Court and Injunctive Relief,” as well as Claimon’s “Supplemental
Motion to Maintain Writ of Stay During Pending Appeal,” are hereby DENIED.
