The Court of Appeals hereby passes the following order:
A27D0071. PHILLIP JOSEPH LANG v. COURTNEY CASH.
In this custody modification action, on July 17, 2026, the trial court entered an
order finding Phillip Joseph Lang in contempt, awarding attorney fees under OCGA
ยง 9-15-14, and ordering his incarceration. Lang filed this application for discretionary
appeal on Tuesday, August 18, 2026. We lack jurisdiction.
To be timely, a discretionary application must be filed within 30 days after entry
of the order or judgment to be appealed. OCGA ยง 5-6-35(d); Court of Appeals Rule
31(a). โThe filing deadline is jurisdictional, and this [C]ourt is unable to accept an
untimely application.โ In the Interest of B. R. F., 338 Ga. App. 762, 762 (791 SE2d 859)
(2016).
Because Lang filed his application for discretionary appeal 32 days after entry
of the order he seeks to appeal, we lack jurisdiction to consider his untimely
application, which is hereby DISMISSED.
