Court of Appeals of the State of Georgia ATLANTA,____________________ August 31, 2026 The Court of Appeals hereby passes the following order: A27D0064. TEYUNIA BURLEY v. NAVY FEDERAL CREDIT UNION. In this action on a debt, on July 7, 2026, the trial court entered a final judgment against Teyunia Burley. Burley filed a direct appeal, which we dismissed for failure to file an application for discretionary appeal as required by OCGA § 5-6-35(a)(6). See Case No. A26A2451 (Aug. 13, 2026). On August 13, 2026, Burley filed this application for discretionary appeal. We, however, lack jurisdiction. A discretionary application must be filed within 30 days of entry of the order sought to be appealed. See OCGA § 5-6-35(d). “Compliance with the discretionary appeals procedure is jurisdictional.” Smoak v. Dep’t of Human Res., 221 Ga. App. 257, 257 (471 SE2d 60) (1996). Here, Burley filed this discretionary application 37 days after entry of the trial court’s order. Under these circumstances, we lack jurisdiction to consider the application, which is hereby DISMISSED. Further, Burley’s motion to stay enforcement of the judgment is hereby DENIED as MOOT.
