Court of Appeals of the State of Georgia Atlanta,____________________ 10/20/2026 The Court of Appeals hereby passes the following order: A27E0043. MICHAEL WARD v. TAMMY WARD. On October 20, 2026, Applicant Michael Ward, proceeding pro se, filed an “Emergency Motion for Extension of Time, Acceptance of Discretionary Application, and, in the Alternative, Leave to File an Out-of-Time Application[,]” requesting that this Court accept his application for discretionary appeal of the trial court’s order dated September 17, 2026. However, an application for discretionary appeal must be filed within 30 days of the order being appealed. See OCGA § 5-6- 35(d). The requirements of OCGA § 5-6-35 are jurisdictional, and this Court may not accept an application for appeal not made in compliance therewith. See, e.g., Boyle v. State, 190 Ga. App. 734, 734 (380 SE2d 57) (1989). Because the time within which Ward was to file any application for discretionary appeal has expired, we are without jurisdiction to consider any such application and his “Emergency Motion for Extension of Time, Acceptance of Discretionary Application, and, in the Alternative, Leave to File an Out-of-Time Application” is therefore DENIED.
