STATE OF FLORIDA
_____________________________
No. 1D20-1588
_____________________________
BRIAN WRIGHT,
Appellant,
v.
STATE OF FLORIDA, DEPARTMENT
OF REVENUE, CHILD SUPPORT
PROGRAM and RONISHA
WILLIAMS,
Appellees.
_____________________________
On appeal from the Division of Administrative Hearings.
Robert E. Meale, Administrative Law Judge.
March 31, 2021
PER CURIAM.
Brian Wright appeals from a final administrative paternity
and support order, contending that the determination of his
income was incorrect. We reverse the order on appeal in view of
Appellee’s confession of error and the apparent inconsistency on
the face of the order that establishes Appellant’s support obligation
based upon “actual” income, while simultaneously recognizing that
Appellant was involuntarily unemployed due to the coronavirus. *
REVERSED and REMANDED.
ROBERTS, OSTERHAUS, and JAY, JJ., concur.
_____________________________
Not final until disposition of any timely and
authorized motion under Fla. R. App. P. 9.330 or
9.331.
_____________________________
Brian Wright, pro se, Appellant.
Ashley Moody, Attorney General, and Toni C. Bernstein, Senior
Assistant Attorney General, Tallahassee, for Appellee Department
of Revenue.
* We affirm the determination of the mother’s income without
comment.
