FIRST DISTRICT COURT OF APPEAL
STATE OF FLORIDA
_____________________________
No. 1D21-1177
_____________________________
MICHAEL RUFFIN,
Appellant,
v.
MAY, Warden, JCI FDOC,
Appellee.
_____________________________
On appeal from the Circuit Court for Jackson County.
James J. Goodman, Jr., Judge.
July 6, 2021
PER CURIAM.
Michael Ruffin appeals the trial court’s order dismissing his
mandamus petition without prejudice and providing leave to file
an amended petition. Because the trial court’s order is a nonfinal,
nonappealable order, this Court dismisses the appeal for lack of
jurisdiction. See Hancock v. Piper, 186 So. 2d 489, 490 (Fla. 1966)
(explaining that “an order dismissing a cause but granting
additional time in which to file an amended complaint is nothing
more than an interlocutory order and [ ] the court still has control
of the litigation”).
ROWE, C.J., and ROBERTS and JAY, JJ., concur.
_____________________________
Not final until disposition of any timely and
authorized motion under Fla. R. App. P. 9.330 or
9.331.
