STATE OF FLORIDA
_____________________________
No. 1D20-3452
_____________________________
SCOTT ALAN KLINE,
Appellant,
v.
MARK S. INCH, Secretary,
Florida Department of
Corrections, T. KEMP and S.
ARNETT,
Appellees.
_____________________________
On appeal from the Circuit Court for Santa Rosa County.
Darlene F. Dickey, Judge.
April 12, 2021
PER CURIAM.
Appellant seeks review of an order denying his petition for
writ of mandamus. Because the notice of appeal was not filed
within 30 days of rendition of the order denying the mandamus
petition, this appeal is dismissed as untimely. This disposition is
without prejudice to Appellantโs right to seek relief in the circuit
court by filing a motion for relief pursuant to Florida Rule of Civil
Procedure 1.540. See Brown v. State, 708 So. 2d 1041 (Fla. 1st
DCA 1998).
B.L. THOMAS, OSTERHAUS, and M.K. THOMAS, JJ., concur.
_____________________________
Not final until disposition of any timely and
authorized motion under Fla. R. App. P. 9.330 or
9.331.
