FIRST DISTRICT COURT OF APPEAL
STATE OF FLORIDA
_____________________________
No. 1D19-3344
_____________________________
EARL JAMES RAY JR.,
Appellant,
v.
MARK S. INCH, Secretary,
Florida Department of
Corrections,
Appellee.
_____________________________
On appeal from the Circuit Court for Leon County.
John C. Cooper, Judge.
March 6, 2020
PER CURIAM.
Because we find no error in the circuit court’s order dismissing
Appellant’s mandamus petition as untimely, we deny Appellee’s
motion for remand and summarily affirm the circuit court’s order.
See Fla. R. App. P. 9.315(a). However, Appellant may pursue the
“alternative avenue of review” set out in Gundlah v. Moore, 831 So.
2d 780 (Fla. 4th DCA 2002).
WOLF, KELSEY, and WINOKUR, JJ., concur.
_____________________________
Not final until disposition of any timely and
authorized motion under Fla. R. App. P. 9.330 or
9.331.

Earl James Ray Jr., pro se, Appellant.
Ashley Moody, Attorney General, and Gecelyne S. Dixon, Assistant
Attorney General, Tallahassee, for Appellee.
