ID No. 30900498DI (N) STATE OF DELAWARE, § § Appellee. § Submitted: September 2, 2026 Decided: September 25, 2026 ORDER On August 10, 2026, the Chief Deputy Clerk sent a notice of brief delinquency to the appellant, Bryant Gibbs, because he had not filed an opening brief by the July 31, 2026 deadline set by the Court. On August 21, the Chief Deputy Clerk issued a notice, sent by certified mail, to Gibbs directing him to show cause why this appeal should not be dismissed for his failure to file an opening brief. Both notices were sent to the mailing address that the Department of Correction has on file for Gibbs. On September 2, the postal service returned the notice to show cause as undeliverable. To date, Gibbs has not responded to the notice to show cause, filed an opening brief, or provided an updated mailing address to the Court. Under the circumstances, dismissal of this appeal is deemed to be unopposed. NOW, THEREFORE, IT IS ORDERED that this appeal is DISMISSED under Supreme Court Rules 3(b)(2) and 29(b).
