AMIR BRUNDGE, §
§ No. 188, 2026
Defendant Below, §
Appellant, § Court Below—Superior Court
§ of the State of Delaware
v. §
§ Cr. ID Nos. 2104008474,
STATE OF DELAWARE, § 2105010558, 2105005329 (K)
§
Appellee. §
Submitted: September 28, 2026
Decided: October 14, 2026
On August 21, 2026, the Clerk’s Office issued a notice, by certified mail,
directing the appellant to show cause why this appeal should not be dismissed for
his failure to file an opening brief by the filing deadline of August 3, 2026. In a
letter dated August 22, 2026, the appellant asked the Court to stay this appeal so that
the Superior Court could rule on a pending motion. Postal records show that the
notice to show cause was delivered by August 26, 2026.
A timely response to the notice was due by September 4, 2026. By letter dated
September 4, 2026, the Clerk’s Office advised the appellant that the Superior Court
docket did not reflect any pending motions and warned him that the appeal would
be dismissed if he did not file an opening brief by September 25, 2026. To date, the
appellant has not filed an opening brief or responded to the notice to show cause.
Dismissal of this appeal is therefore deemed to be unopposed.
NOW, THEREFORE, IT IS ORDERED that this appeal be DISMISSED
under Supreme Court Rules 3(b)(2) and 29(b).
