ORDER
On July 13, 2026, the Chief Deputy Clerk sent a notice of brief delinquency
to the appellant, Gerald Aikens, because he had not filed an opening brief by the July
8 deadline set by the Court. On July 27, the Chief Deputy Clerk issued a notice, sent
by certified mail, to Aikens directing him to show cause why this appeal should not
be dismissed for his failure to file an opening brief. Both notices were sent to the
mailing address that the Department of Correction has on file for Aikens. On August
6, the postal service returned the notice to show cause as undeliverable. To date,
Aikens has not responded to the notice to show cause, filed an opening brief, or
provided an updated mailing address to the Court. Under the circumstances,
dismissal of this appeal is deemed to be unopposed.
NOW, THEREFORE, IT IS ORDERED that this appeal be DISMISSED
under Supreme Court Rules 3(b)(2) and 29(b).
