STATE OF LOUISIANA
COURT OF APPEAL, FIRST CIRCUIT
CORRECTED ACTION
COLT €OB¥Y M. LANDRY NO. 2026 CW 1291
VERSUS
REAGAN MARTINEZ OCTOBER 29, 2026
In Re: Reagan Martinez Celt M.—bandey, applying for supervisory
writs, 18th Judicial District Court, Parish of
Tberville, No. 84301 c/w 82466.
BEFORE : THERIOT, GREENE, AND EDWARDS, Ju.
WRIT GRANTED. We find the trial court erred in denying the
exception of lack of subject matter jurisdiction filed by
defendant, Reagan Martinez. The trial court erred in finding that
the minor child’s home state was Louisiana under the Uniform Child
Custody Jurisdiction Enforcement Act, La. R.S. 13:1801 et seq.,
and improperly applied the Military Parent and Child Custody
Protection Act, La. R.S. 9:359, et seq.; Baxter v. Baxter, 2015-
0085 (La. App. 4th Cir. 6/24/15), 171 So.3d 1159. The minor child
was born in Italy and has resided with his mother, Reagan Martinez,
in Italy since his birth in June 2023. Therefore, we find the minor
child’s home state is Italy under La. R.S. 13:1813(A) (1).
Accordingly, we reverse the trial court’s July 28, 2026 judgment
denying the exception of lack of subject matter jurisdiction filed
by defendant, Reagan Martinez, grant the exception of lack of
subject matter jurisdiction, and dismiss plaintiff, Colt Landry’s,
petition.
