Court of Appeals of the State of Georgia ATLANTA,____________________ September 01, 2026 The Court of Appeals hereby passes the following order: A27A0228. PHILLIP C. DUNN v. THE STATE. Phillip C. Dunn was convicted of murder and other crimes. The Supreme Court of Georgia affirmed his conviction on appeal in Dunn v. State, 292 Ga. 359 (736 SE2d 392) (2013). In 2026, Dunn filed a motion for out-of-time appeal, which the trial court dismissed. He now appeals to this Court. The Supreme Court currently exercises jurisdiction over all “non-death-penalty murder appeals,” and this Court is required to transfer such cases. See Hart v. State, 322 Ga. 1, 10(1) (917 SE2d 631) (2025); Coleman v. State, Case No. S26A0859 (August 13, 2026) (preserving the Supreme Court’s direct appellate jurisdiction over all appeals in murder cases until July 1, 2027). The Supreme Court’s jurisdiction also includes appeals from orders resolving post-judgment motions in such murder cases. See, e.g., Simpson v. State, 292 Ga. 764 (740 SE2d 124) (2013). Accordingly, we hereby TRANSFER this appeal to the Supreme Court for disposition.
