FIRST DISTRICT COURT OF APPEAL
STATE OF FLORIDA
_____________________________
No. 1D21-0270
_____________________________
ROBERT SHARP,
Petitioner,
v.
STATE OF FLORIDA,
Respondent.
_____________________________
Petition for Writ of Mandamus—Original Jurisdiction.
July 29, 2021
PER CURIAM.
In this mandamus petition, docketed January 25, 2021,
Petitioner seeks review of the “Order on Defendant’s Motion to
Withdraw Plea” rendered June 18, 2019. Because this order is
reviewable by plenary appeal, the Court treats the petition as a
notice of appeal. However, as this appeal was not timely
commenced, this cause is dismissed for lack of jurisdiction. See Fla.
R. App. P. 9.110(b); Fla. R. App. P. 9.140(a).
B.L. THOMAS, M.K. THOMAS, and LONG, JJ., concur.
_____________________________
Not final until disposition of any timely and
authorized motion under Fla. R. App. P. 9.330 or
9.331.
