Trial Attorneys ORDER OF DISMISSAL FOR FAILURE TO PROSECUTE On December 3, 2025, appellant timely filed its notice of appeal challenging the Navy’s termination of its contract for cause. After the parties filed their pleadings, the Navy moved for partial dismissal, arguing the Board did not have jurisdiction over appellant’s additional allegations in its complaint relating to government-caused and/or excusable delay. By Order dated May 27, 2026, appellant was directed to respond to the government’s motion for partial dismissal within 30 days. Appellant did not respond to that Order. Appellant also did not respond to Orders dated June 30, 2026 and July 29, 2026, directing it to submit its response to the government’s motion. On August 20, 2026, the government moved to dismiss the appeal for failure to prosecute, citing appellant’s failure to respond to the Board’s three Orders. By Order dated August 27, 2026, the Board directed appellant to either respond to the Navy’s motion for partial dismissal within 21 days or show cause why the appeal should not be dismissed with prejudice under Board Rule 17. To date, the Board has received no response from appellant. Accordingly, this appeal is dismissed with prejudice under Board Rule 17 for failure to prosecute. Dated: October 6, 2026 OWEN C.
