1 Amanda Mayfield and Douglas Mayfield, Petitioners v. Nancy DeLaCroix; MetLife Auto Home Insurance Agency n/k/a Farmers General Insurance Agency, Inc., a Rhode Island corporation; American Strategic Insurance Corp. d/b/a Progressive Home, a Florida corporation; and Marshall Swift/Boeckh, LLC, a Delaware corporation. Respondents No. 26SC234 Supreme Court of Colorado, En Banc October 12, 2026 Court of Appeals Case No. 24CA2026 Petition for Writ of Certiorari GRANTED. Whether the court of appeals erred in holding, as a matter of law, that a licensed insurance agent owes no duty to an insured with respect to a policy renewal when the agent's affirmative written misrepresentation during the original procurement directly caused, and continuously sustained, the insured's underinsurance through each successive renewal period and through the date of the total loss. Included in this issue is whether Progressive, and or Metlife, are vicariously liable for the negligence of their agent. 2 Whether Kaercher v. Sater , 155 P.3d 437 (Colo.App. 2006), which holds that a licensed insurance agent has no continuing duty to advise, guide, or direct a client to obtain adequate coverage, conflicts with established common law principles governing professional liability and voluntary assumption of duty, and whether the factors establishing a "special relationship" of entrustment between an agent and an insured require clarification by this court. DENIED AS TO ALL OTHER ISSUES.
