MEMORANDUM OPINION
No. 04-26-00179-CR
Jesus Torres VELA,
Appellant
v.
The STATE of Texas,
Appellee
From the 144th Judicial District Court, Bexar County, Texas
Trial Court No. 2025-CR-007873
Honorable Michael E. Mery, Judge Presiding
PER CURIAM
Sitting: Rebeca C. Martinez, Chief Justice
Irene Rios, Justice
Velia J. Meza, Justice
Delivered and Filed: September 30, 2026
DISMISSED
Jesus Torres Vela was convicted of possession of substance penalty group 1 or 1-B less
than one gram, a state jail felony. TEX. PENAL CODE § 481.115(b). On March 4, 2026, Vela filed
his notice of appeal. After failing to timely file his brief or respond to our orders, this Court abated
the appeal and ordered the trial court to determine whether appellant desired to prosecute this
appeal.
04-26-00179-CR
A supplemental clerk’s record was filed on August 18, 2026, containing the trial court’s
findings. The trial court made findings that Vela served his 120-day sentence in the Bexar County
Jail, which was satisfied on February 18, 2026. Upon Vela’s release, he was apprehended by
Immigration and Customs Enforcement, cannot be located, and that under these circumstances,
Vela abandoned his appeal.
Based upon the trial court’s findings that Vela abandoned his appeal, we conclude that
good cause exists to suspend Texas Rule of Appellate Procedure 42.2(a) in this case. See TEX. R.
APP. P. 42.2(a). Accordingly, we dismiss this appeal.
