[Cite as State v. Riedmaier, 2026-Ohio-4257.] IN THE COURT OF APPEALS OF OHIO SIXTH APPELLATE DISTRICT WOOD COUNTY State of Ohio Court of Appeals No. WD-26-036 Appellee Trial Court No. 2026CR0069 v. Robert Damien Riedmaier DECISION AND JUDGMENT Appellant Decided: October 27, 2026 ***** Paul A. Dobson, Wood County Prosecutor, and David B. Lemon, Assistant Prosecutor for appellee. Jeffrey P. Nunnari, for appellant. ***** SULEK, J. {¶ 1} Defendant-appellant, Robert Damien Riedmaier, appeals the April 17, 2026 judgment of the Wood County Court of Common Pleas which, after he pleaded guilty to domestic violence, sentenced him to a 15-month imprisonment term. Pursuant to App.R. 12, the judgment entry is modified. I. Background {¶ 2} On February 19, 2026, the Wood County Grand Jury indicted Riedmaier on one count of domestic violence, R.C. 2919.25(A), 2919.25(D)(3), a fourth-degree felony. On February 26, 2026, Riedmaier pleaded guilty to the charge in the indictment. The court sentenced Riedmaier to 15 months of imprisonment and two years of discretionary postrelease control. This appeal followed. II. Assignment of Error {¶ 3} Riedmaier presents the following assignment of error: The trial court’s sentencing entry does not accurately reflect what happened in court and is in need of correction. III. Analysis {¶ 4} Riedmaier’s sole assignment of error requests that the trial court be ordered to issue a nunc pro tunc judgment entry removing the sentence: “The Defendant made a statement,” to reflect that he did not make a statement at sentencing. The State has no objection. {¶ 5} Under App.R. 12(A)(1)(a) and (B), this court has the authority to “[r]eview and affirm, modify, or reverse the judgment or final order appealed.” App.R. (A)(1)(a); Johnson’s Island Property Owners’ Assn. v. Cianciola, 2021-Ohio-1341, ¶ 62 (6th Dist.), quoting Quest Workforce Solutions, LLC v. Job1USA, Inc., 2018-Ohio-3304, ¶ 23 (6th Dist.). Therefore, pursuant to App.R. 12, we modify the judgment by striking the 2. incorrect reference to Riedmaier making a statement at sentencing. Riedmaier’s assignment of error is well-taken. IV. Conclusion {¶ 6} Upon due consideration, we modify the April 17, 2026 judgment entry by striking the sentence: “The Defendant made a statement” on page two, paragraph two, of the April 17, 2026 judgment entry. The remainder of the Wood County Court of Common Pleas’ judgment is affirmed. Pursuant to App.R. 24, the State is ordered to pay the costs of this appeal. Judgment affirmed. A certified copy of this entry shall constitute the mandate pursuant to App.R. 27. See also 6th Dist.Loc.App.R. 4. Christine E. Mayle, J. JUDGE Gene A. Zmuda, J. JUDGE Charles E. Sulek, J. CONCUR.
