STATE OF HAWAIʻI, Plaintiff-Appellee,
v.
CALMENTINA PEDRO, Defendant-Appellant.
APPEAL FROM THE DISTRICT COURT OF THE SECOND CIRCUIT
WAILUKU DIVISION
(CASE NO. 2DTC-25-013971)
ORDER GRANTING MOTION TO DISMISS APPEAL
(By: Leonard, Presiding Judge, McCullen and Gluck, JJ.)
Upon consideration of the Stipulation to Dismiss
Appeal, filed September 30, 2026, by Defendant-Appellant
Calmentina Pedro (Pedro), which the court construes as a motion
to dismiss appeal because it is not signed by all parties, the
papers in support, and the record, it appears that:
(1) The appeal was docketed on August 3, 2026;

(3) The stipulation is dated and signed only by
Pedro's counsel, who represents that counsel for Plaintiff-

Appellee State of Hawaiʻi (State) approved the stipulation via
email and waived signature, although the deputy prosecuting
attorney who purportedly approved the stipulation has not
entered an appearance and is not counsel of record for the State
in this appeal;
(4) The stipulation includes Pedro's declaration
showing she understands the consequences of voluntary dismissal,
consistent with HRAP Rule 42(c); and
(5) Dismissal is authorized by HRAP Rule 42(b) and
(c).
Therefore, IT IS HEREBY ORDERED that the appeal is
dismissed.
