The Court of Appeals hereby passes the following order:
A27A0455. CLINTON DAVIS v. THE STATE.
Following a jury trial, Clinton Davis was convicted on counts of burglary, armed
robbery, possession of a firearm during the commission of a felony, aggravated assault,
and kidnapping. We affirmed Davis’s convictions in an unpublished opinion. See Case
No. A16A2169 (Mar. 13, 2017). Davis filed a petition for a writ of habeas corpus,
which the trial court denied, except to vacate the sentences for two counts of
kidnapping. On October 30, 2025, the trial court entered an amended sentence. On
December 2, 2025, Davis filed his notice of appeal from the trial court’s order.1 We,
however, lack jurisdiction.
A notice of appeal must be filed within 30 days after entry of the order to be
appealed. OCGA § 5-6-38 (a). The proper and timely filing of a notice of appeal is an
absolute requirement to confer jurisdiction on this Court. Kelly v. State, 311 Ga. 827,
828 (860 SE2d 740) (2021). Here, Davis filed his notice of appeal 33 days after the
trial court’s order was entered. Consequently, this appeal is hereby DISMISSED for
