FIRST DISTRICT COURT OF APPEAL
STATE OF FLORIDA
_____________________________
No. 1D19-3062
_____________________________
JEROME DICKEY,
Appellant,
v.
STATE OF FLORIDA,
Appellee.
_____________________________
On appeal from the Circuit Court for Leon County.
Francis Allman, Judge.
June 3, 2020
PER CURIAM.
We affirm the lower court’s order on the merits. However, we
remand for correction of a scrivener’s error contained in
Appellant’s conviction for burglary of a dwelling while armed. See
Boggs v. Wainwright, 223 So. 2d 316, 317 (Fla. 1969). The
judgment and sentence identify this conviction as a life felony,
rather than as a first-degree felony punishable by life. Appellant
need not be present for the correction of the error.
B.L. THOMAS, WINOKUR, and JAY, JJ., concur.
_____________________________
Not final until disposition of any timely and
authorized motion under Fla. R. App. P. 9.330 or
9.331.
