ON APPEAL FROM THE 370TH DISTRICT COURT OF HIDLAGO COUNTY, TEXAS MEMORANDUM OPINION Before Justices Silva, Peña, and West Memorandum Opinion by Justice Peña This matter is before the Court on a joint motion to vacate trial court’s judgment and dismiss case and on appellant’s motion for extension of time to file brief. See TEX. R. APP. P. 42.1(a)(2)(B). The parties have settled all claims between them in this appeal and move to vacate the trial court’s judgment and dismiss this case. See id. R. 42.1(a), 43.2(e). We grant the joint motion, vacate the trial court’s order granting default judgment entered in C-1166-26-G and dismiss the appeal. In accordance with the joint motion and parties’ apparent agreement, costs are taxed against the party incurring the same. Having dismissed the appeal at the parties’ request, no motion for rehearing will be entertained, and appellant’s motion for extension of time to file a brief is dismissed as moot. Finally, we instruct the Clerk of the Court to issue the mandate forthwith, as requested. L. ARON PEÑA JR. Justice Delivered and filed on the 22nd day of October, 2026. 2
